Information shared by the user on the TLR platform such as name, phone number, emergency contact number, gender, occupation, hometown, personal interests, email address, medical history and any other information shared with a TLR Professional shall be deemed to be “Personal Information” under the T&C. TLR collects this Personal Information to provide a smooth, efficient and customised experience to the user. The collection of Personal Information also enables the user to create an account and profile that is used to interact with the TLR Professional

TLR is dedicated to maintaining the privacy and integrity of the Personal Information of the user at all times. Personal information shared by the user on the TLR platform will be used for:

• Identify and reach the user;
• Resolve service and billing problems;
• Assist in scheduling appointments, send reminder for upcoming or follow-up appointments, and intimate about cancelled appointments;
• Provide the user with further information related to products and services available on the TLR platform;
• Better understand the users’ needs and interests;
• Run statistical research (such research will only use the information in an anonymous way and cannot be linked back to the user);
• Make disclosures as may be required under applicable law
• Improve the website or mobile application in order to better serve the user;
• Run a contest, promotion, survey on the TLR platform;
• Process any financial transaction in a timely manner.

By using the TLR platform, providing Personal Information or making a payment on the TLR platform, the user consents to the collection, storage, processing, disclosure and transfer of Personal Information in accordance with the provisions of this privacy policy and under the data privacy laws in India. If the user does not provide with the relevant Personal Information or at point in time withdraws the consent to make such Personal Information accessible to the TLR Professional, the TLR platform is not obligated to fulfil the purpose for which the said Personal Information was sought.

The TLR Professional will take all reasonable precautions to protect the confidential information obtained directly through the user or stored in any medium on the TLR platform. Given TLR’s aim of delivering high-quality services, all professionals working with the platform are required to be part of a regular supervision structure where all cases are discussed.

If there is a threat to the well-being of the client themselves or to someone else (cases involving harm to self or others), the TLR Professional will be obligated to share information with the clinical supervisor and others, including emergency contacts, and other people deemed fit and essential to maintain safety, including but not limited to family, friends and law enforcement authorities, or to comply with legal requirements.

In the event the user is required to or chooses to seek a consultation from another mental health or medical professional, clinically significant information can be shared with the relevant professional with the consent of the user.

Except for the reasons outlined above, any information shared on the TLR platform will only be shared with others with prior permission of the user.

TLR reserves the right to add, change, or remove sections from the Privacy Policy without notice or liability to any third-party.

Any interaction and its related outcome on the TLR platform is strictly between the TLR Professional and the client and TLR shall not be held responsible for the same. The user agrees that any engagement with a professional on the TLR platform is done so at their own discretion. TLR makes no representations concerning, and does not guarantee, the accuracy of any services, including, but not limited to, any information provided through the services on the TLR platform or their applicability to the individual circumstances of the user.

TLR may provide the user with access to third-party tools as it deems fit which the TLR platform neither monitors nor has any control or input over. TLR is not responsible for examining or evaluating the accuracy of such tools. Any use by the user of such optional tools offered through the TLR platform is entirely at the discretion of the user.

The T&C and any policies posted by TLR on this platform constitutes the entire agreement and understanding between the user and TLR and it will govern the use of all services provided by the TLR platform, superseding any prior agreements, communications and proposals, whether oral or written, between the user and TLR.

The failure on the part of TLR to exercise or enforce any right or provision of this T&C shall not constitute a waiver of such right or provision.

The T&C is effective unless and until terminated by either parties. The obligations and liabilities of the user and TLR incurred prior to termination date shall survive the termination of these T&C for all purposes.

The user may terminate the T&C at any time by notifying the TLR platform, subject to settlement of all outstanding payments. TLR may in its sole judgement decide that the user has failed to comply with any term or provision of the T&C, and subsequently terminate the T&C at any time without notice and the user will remain liable for all amounts due up to and including the date of termination.

TLR reserves its right to correct any typographical error, inaccuracy or omission on the TLR platform that may relate to a product, service description, pricing, promotions or offers at any time without prior notice

The user agrees to indemnify, defend and hold TLR and its subsidiaries, affiliates, partners, officers, directors, professionals, employees and interns, harmless against any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of the breach of the T&C.

In the event any provision of the T&C is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from the T&C. This shall not affect the validity and enforceability of the other provisions under the T&C.

Jurisdictional policies of TLR have been drafted in accordance and compliance with Indian laws. Any and all disputes arising between the user and TLR with regards to the T&C, including its interpretation shall be subject to the exclusive jurisdiction of the courts at Mumbai, India.
